Section 1404 of New York’s Surrogate’s Court Procedures Act allows potential contestants to a will or probate proceeding to examine witnesses and request documents before making an objection. This program will provide important tips and techniques for representing objectors to a will, for representing those attempting to uphold the testator’s wishes, or for representing the preliminary executor. You will also gain advice for conducting the original will-signing ceremony in a manner that helps to preclude future objections.
The presenters have lectured for the Academy on various wills-and-estates topics, always to rave reviews. In this presentation, they will cover the law, provide procedural tips, cite key cases, and conduct a mini-mock examination that you will undoubtedly remember in your own 1404 examination proceedings.
