Farrell Fritz Helps to Secure Victory for Policyholders in $102 Million Insurance Coverage Dispute

On June 4th, 2026 Farrell Fritz Commercial Litigation partner, Frank McRoberts, alongside associate, James Maguire, secured a winning judgment for policyholders issued by Dutchess County Supreme Court Justice Thomas R. Davis. The case arose from an insurance coverage dispute related to a natural gas explosion in Wappingers Falls, New York in November 2023.

A pre-disclosure grant of summary judgment was obtained, with the Court ruling that the insurers’ disclaimer of coverage was untimely under New York Insurance Law § 3420(d)(2). The Court also issued a declaratory judgment confirming the insurers’ duties to defend and indemnify, thereby securing access to a $102 million tower of commercial general liability coverage.
