Contested Article 81 Guardianship Proceedings

Robert M. Harper will be presenting at the New York State Bar Association on “Contested Article 81 Guardianship Proceedings.”

This program will serve as primer for attorneys who represent clients in contested Article 81 guardianship proceedings. The program will address substantive and procedural issues that regularly arise in contested guardianship proceedings, including whether to seek guardianship for capacity or based upon consent, the applicable burdens of proof, best trial practices, common evidentiary issues, available temporary appointments, fee allocation considerations, and jury trial rights. In doing so, the program will ensure that practitioners are well prepared to handle contested guardianship proceedings, from start to finish.
