John Morken is a partner concentrating in the area of trust and estate litigation in the Surrogate's courts and other trial and appellate courts throughout New York. His practice includes probate contests, discovery proceedings, accountings, and commercial litigation related to estates. He is a contributor to Farrell Fritz's New York Trusts & Estates Litigation blog.
In March 2001, Mr. Morken was elected to the American College of Trust and Estate Counsel. A frequent lecturer on estate litigation topics, Mr. Morken is Chair of the Legislation Committee of the Trusts and Estates Section, the New York State Bar Association and is a member of the Section's Executive Committee. Before coming to Farrell Fritz, Mr. Morken served as Law Secretary to Justice David T. Gibbons of the Appellate Division, Second Department of the New York State Supreme Court. Mr. Morken is the co-author of Representing the Fiduciary: Ethical and Practical Considerations for the Estates Attorney and Early Detection of Potential Conflicts in Ethical Obligations of Fiduciaries Can Prevent Later Problems, New York State Bar Journal -- December, 2001 and January, 2002, "Steps Taken While Testator Is Alive Can Play A Key Role in Upholding Client's Estate Plan After Death", New York State Bar Journal, December, 1999; "The Dead Man's Statute - Still Alive in the Surrogate's Court" and "Disqualification of Counsel in the Surrogate's Court" appearing in the Trusts and Estates Law Section Newsletter of the New York State Bar Association, and "Survey of Estate Litigation", presented to the Association of the Bar of the City of New York at the March, 1999 Seminar Estate Litigation for Beginners and Non-Specialists. Mr. Morken was the Co-chair of the Trust and Estates Law Section Annual Meeting, January, 1999, in Program entitled "Settling Litigation in the Surrogate's Court". He chaired the Trust and Estates Law Section Annual Meeting, January, 1996, in Program entitled "Bearing the Draftsman's Burden: The Shifting Standards of Capacity", and Co-chaired the Trust and Estates Law Section Fall Meeting, 1989, "The Trial of a Will Contest". Mr. Morken is also a member of the Nassau County, Suffolk County and New York City Bar Associations.
Mr. Morken was selected for inclusion in 2008 New York Super Lawyers® - Metro Edition (Estate Planning & Probate). In 2009, he was named to the list in the Estate & Trust Litigation practice area.
A graduate of New York University School of Law, Mr. Morken received his Juris Doctor in 1977 and his Bachelor of Arts Degree with Honors in Mathematics and Philosophy from Swarthmore College in 1974. He is admitted to practice in the State of New York and in the Southern and Eastern Districts of the Federal Court, the Second Circuit Court of Appeals, and the Tax Court. Mr. Morken has an AV Martindale-Hubbell Peer Review Rating.
