Robert M. Harper is an associate in the trusts and estates and commercial litigation departments, concentrating in trust and estate-related litigation in Surrogate's Courts and Supreme Court. Mr. Harper's practice includes probate contests, accounting proceedings, discovery and turnover proceedings, guardianship proceedings, and actions to partition real property. He is a frequent contributor to Farrell Fritz's New York Trusts & Estates Litigation blog.
Mr. Harper is a Special Professor of Law at Hofstra University School of Law, where he teaches the Moot Court Competition Seminar. Additionally, Mr. Harper coaches several of Hofstra's moot court teams, including the National Moot Court Competition team, and serves on the Law School's Recent Alumni Committee.
Mr. Harper has authored articles for the following professional publications: Probate & Property, a publication of the Real Property, Trust and Estate Law Section of the American Bar Association; the New York State Bar Association Journal; The Nassau Lawyer; The Suffolk Lawyer; Michigan State University's Journal of Medicine and Law; and Quinnipiac University's Probate Law Journal.
"Vacating Surrogates Court Judgments, Orders and Decrees," an article Mr. Harper co-authored with Farrell Fritz, P.C. trusts and estates partner Eric W. Penzer for the New York State Bar Association Journal, was cited by Harris 5th N.Y. Estates: Probate, Administration & Litigation, a leading authority on trust and estate practice in New York State. Moreover, Mr. Harper's article, "Dead Hand Problem: Why New York's Estates, Powers and Trusts Law Should Be Amended to Treat Posthumously Conceived Children as Decedents Issue and Descendants," has been cited in Probate & Property, the George Mason Law Review, the St. John's Journal of Legal Commentary and the Quinnipiac Probate Law Journal.
Mr. Harper's previous legal experience includes positions as a law intern to the Honorable Arthur D. Spatt, Senior U.S. District Judge for the Eastern District of New York; to the Honorable E. Thomas Boyle, U.S. Magistrate Judge for the Eastern District of New York; and to the Honorable Lawrence J. Brennan, Acting Justice of the Supreme Court of the State of New York. He also served as a law clerk at Westermann Hamilton Sheehy Aydelott & Keenan, LLP (Garden City, NY) and as a research assistant to Professor Kathleen Beckett.
Mr. Harper earned his Juris Doctor degree, cum laude, in May 2007 from Hofstra University School of Law. He was a staff member of the Hofstra Law Review and the Moot Court Association.
Mr. Harper received his B.S. in Finance and History in 2004 from Boston College Carroll School of Management. While in Boston, Mr. Harper volunteered at soup kitchens and homeless shelters as part of the Boston College Urban Immersion Program.
Mr. Harper is actively involved in the Suffolk County Bar Association, where he serves as co-chair of the Member Services and Activities Committee. In addition, he is a member of the New York State Bar Association and Nassau County Bar Association.
Mr. Harper is admitted to practice in New York, New Jersey and the United States District Court for the District of New Jersey.
