A lawsuit that halted the awarding of a contract in February to demolish the Central Warehouse in downtown Albany is going to take several months more before there’s an outcome in court. Matthew Wagoner shares his thoughts with the Albany Business Review.

An attorney not involved in the case who was interviewed by the Albany Business Review said oral arguments in civil court are scheduled at the discretion of the judge.
“It allows the judges to prepare in advance of oral argument by reviewing the papers and coming up with some discreet questions to press the lawyers with so they can clarify factual or legal distinctions at issue in the case,” said Matt Wagoner of Farrell Fritz in Albany.
Some judges opt instead to rule based on the motions that have been filed, he said.
As for the four-month wait until the oral arguments, Wagoner said the timing isn’t unusual given the heavy caseload in state Supreme Court and the shortage of judges.
“It’s obviously not ideal, but these cases can drag out longer than litigants expect,” said Wagoner, who has practiced law for nearly 20 years and once clerked for a state Supreme Court justice.
