Starting August 1, 2025, New York City’s Taxi and Limousine Commission (TLC) will implement a higher mandatory per-trip payment for ride-hail drivers. This updated minimum payment formula represents a significant step toward ensuring better pay for independent contractor drivers, all while avoiding the classification of drivers as full-time employees.
Domenique Camacho Moran shared her insights with Law360 about the growing trend to secure better pay and benefits for gig workers, despite the ongoing uncertainty around their employment classification:
“The position in New York City seems to be, ‘Let’s put a pin in the conversation over whether these are employees or independent contractors and instead let’s focus on how to provide certain benefits,'” says Domenique Camacho Moran, Partner at Farrell Fritz PC. “Having the standard for minimum pay certainly changes some of the incentive for arguing about employment classification.”
