Judge Chen’s pre-trial summary judgment ruling that the tweets were false and reckless put the Tesla defendants at a disadvantage, said Alon Kapen of Farrell Fritz, adding that most securities defense lawyers would try to settle the case at that stage.

“In a way, [Musk] was fighting with one hand behind his back because of the initial ruling,” Kapen said. “So given those circumstances, the jury verdict was surprising.”
