Principal Deputy Chief, Civil Division of E.D.N.Y. U.S. Attorney’s Office, Joins Farrell Fritz as a Commercial Litigation Partner

Kevin P. Mulry has joined Farrell Fritz as a commercial litigation partner.

Prior to joining the firm, Mr. Mulry served for fifteen years as an Assistant United States Attorney in the Civil Division of the U.S. Attorney’s Office for the Eastern District of New York. From 2005 through 2010, he was Principal Deputy Chief of the Civil Division, with supervisory responsibility for the office’s affirmative civil litigation, including health care fraud, mortgage and government procurement fraud, civil rights, environmental litigation, civil racketeering and labor litigation, civil penalty actions, financial litigation and civil and criminal forfeiture. He was previously Chief of the Long Island Civil Division, supervising the affirmative and defensive work in the Long Island office, and Chief of Employment Litigation, overseeing the employment cases in the district.

Mr. Mulry, the federal government’s lead lawyer in connection with the Shinnecock Indian Nation’s quest for recognition as an Indian tribe, has extensive trial and litigation experience in all areas of civil litigation through trial and appeal. He has tried cases involving employment discrimination, criminal forfeiture, tort, medical malpractice and environmental law. He has coordinated the national investigation of pharmaceutical health care fraud cases under the False Claims Act, including allegations of off-label marketing, kickbacks and improper billing. He has also argued numerous appeals to the U.S. Court of Appeals for the Second Circuit.

Notable cases he has handled include the Benefit Plan Administrators prosecution, a bribery, fraud and obstruction of justice case arising out of the awarding of two multi-million dollar health care contracts by a municipality, and the Hickey and Avellino Carting cases, involving forfeiture and monitorship of carting companies controlled by organized crime. In 2004, he received the Henry L. Stimson Medal from the Association of the Bar of the City of New York for outstanding service as an Assistant United States Attorney.

Mr. Mulry, a Rockville Centre, NY, resident, received his Juris Doctor degree, magna cum laude, from St. John’s University School of Law and his Bachelor of Arts degree, summa cum laude, from St. John’s University. Mr. Mulry was a member of St. John’s Law Review.

Mr. Mulry was a law clerk to the Honorable John E. Sprizzo, United States District Judge for the Southern District of New York. He was previously associated with Simpson
Thacher & Bartlett in New York. He has also been an Adjunct Professor of Law at St. John’s University School of Law.

Mr. Mulry is a member of the Federal Bar Council. He is admitted to practice in New York, to the United States District Courts for the Eastern and Southern Districts of New York, and to the United States Court of Appeals for the Second Circuit.
