Construction

Representing owners, construction professionals, contractors, and suppliers with integrity, efficiency, and hands-on experience.

Farrell Fritz’s construction law group includes attorneys recognized throughout the state of New York and the Northeast as leaders in the industry. We advise prime and trade contractors, owners/developers, architects, engineers, design firms, healthcare and educational institutions, and public entities with respect to all phases of construction. Members of our construction group also have worked in-house on the client side, which enables us to provide practical strategies to help clients protect their profits, minimize delays and expenses, enforce their contract rights, and resolve disputes.  Our attorneys counsel clients on risk management strategies, effective project organization, and when problems arise on a construction project.

Clients trust our construction attorneys for guidance in:

  • Drafting and negotiating contracts with public and private entities
  • Construction contracts of every type—for both owners and contractors
  • Construction risk assessment and avoidance
  • Owner/developer project management development and representation
  • Claims prevention, preparation, and negotiation
  • Surety bond issues (i.e., payment, performance and bid bonds)
  • LEED—Leadership in energy and environmental design, sustainable design and “green” building design.
  • Property damage claims
  • OSHA and workplace safety guidance and claim avoidance
  • Federal and state procurement issues
  • Insurance coverage and disputes
  • BIM (building information modeling)
  • Construction licensing issues
  • New York City Department of Buildings (DOB) and Environmental Control Board (ECB) claims and violation resolution

Experienced Construction Litigators

Our attorneys appear in state and federal trial and appellate courts, before administrative agencies, and are involved in arbitrations and mediations regarding:

  • Delay, inefficiency, and interference claims
  • Defense and prosecution of complex construction claims
  • Claims related to nonpayment, change orders, design errors
  • Contract defaults and termination
  • Bid protests and award disputes
  • Mechanics’ liens and public improvement liens
  • Property damage claims
  • Insurance coverage and disputes
