Spotting undue influence is often no easy task for estate planning attorneys and presents a difficult burden of proof for estate litigators. Further, there is the potential for physical and psychological abuse of those with diminishing capacity. What can attorneys do to identify and protect against undue influence and effectively litigate the issue? This program will examine the trust and estates attorney’s age-old problem from the civil and criminal perspectives of a an estate planner, an estate litigator and the District Attorney’s Office, with an eye toward identifying undue influence and preventing it in an era of an aging population. Additionally, speakers from the Nassau County District Attorney’s Office will discuss a new multi-disciplinary team approach that will bring together prosecutors, law enforcement, service providers, and other agencies that work in this field, to review cases and coordinate responses in order to improve outcomes, as well as raise public awareness about the issue of elder abuse and the availability and access to services.
