Today’s headline news of economic crises, international unrest and political battles for the White House impact us individually and as estate and trust practitioners in counseling our clients. As fiscal woes mount, so does the threat of litigation. While a fiduciary’s duties, responsibilities and possible exposure to liability are always a concern, these issues pose even greater concern in these turbulent times.

Ilene S. Cooper, partner, is the program chair and a course book co-editor. Joseph T. La Ferlita, associate, is a course book co-editor and will be speaking at the meeting. John (Jack) J. Barnosky, partner, will also be speaking at the meeting.

On Friday, September 26, a fact pattern and PowerPoint presentation will be presented. From 8:30 a.m. to 8:45 a.m., Ilene will give the program introduction. From 8:45 a.m. to 9:35 a.m., Jack will be one of three speakers discussing, ā€œDevelopments in the Law of Fiduciary Management and Liability: Diversification, Delegation, Arbitration and Total Return InvestingĀ. This discussion will address, in part, delegation issues, the decision in Estate of Blumenkrantz as it impacts the Prudent Investor statute, the opinion in Estate of Dumont, surcharge/damage issues since Matter of Janes, and defending claims of investment imprudence.

On Friday, September 27, Ilene will again give the program introduction from 8:30 a.m. to 8:45 a.m. Joseph will be one of several panel members discussing E-Filing.

Attendance at this meeting offers up to 6.0 MCLE credit hours (5.0 credit hours in professional practice and 1.0 credit hour in ethics). Except for any ethics credit, this is NOT a transitional program and is NOT suitable for MCLE credit for newly-admitted attorneys.
