When objections to a will surface, the 1404 examination is usually the first step in trying to determine whether the testator was incompetent or subject to undue influence or duress. A skilled faculty from Farrell Fritz’s estate litigation group will provide advice for both attorneys representing objectors and those trying to uphold the testators’ perceived wishes. You will also gain advice for properly selecting and preparing witnesses to a will.
